Terms of Service Highlights

Our Terms of Service covers all of the terms and conditions under which we provide the nimbus cloud computer service to you. It's a full legalese version that our lawyers made us put up. But we think that it is helpful for those of you who would like a little plain language to see some of the the highlights of items covered below.:

  • The nimbus cloud computer is a service delivered through your internet connection - the nimbus is extraordinary in many ways not the least of which is that it is not an ordinary computer. It's a service. It gets all its power from our data centers and it comes to you through an internet connection. And your service with us is month-to-month and no long term agreements are required.
  • Monitor not included. We send you a lot of stuff but we can't afford to throw in a monitor as well. We can get one real cheaply for you so check what we have when you order. Just about any VGA monitor you have will work with nimbus. Check on our supported hardware page.
  • Not all USB devices supported. We maintain a list of USB devices that we have tested with the nimbus and you can check there to see if we support yours. We can't support all of the thousands and thousands of devices in existence but you can check our supported hardware page to see if we do.
  • You need to provide your own broadband connection. We need at least 768 kbps and more is better. (Hey, with all the money you're saving why not step up to faster broadband now?)If you are not connected to the internet, the nimbus does not function. Thought we would make that point even though it should be obvious! Hey, we have lawyers to keep happy!
  • We require a credit card hold for the MSRP of the nimbus device in the amount of $50. The nimbus device is yours to use for as long as you are a customer and you will not be charged separately for it. But, these little puppies cost us real cash to make. If you cancel your service and you don’t want to return it, that's fine, just pay us $50 and it's yours (that's why we put a $50 hold on your credit card). If you are a free customer and you end up not using the device, then we will ask you to return it as well. There are lots of folks waiting in line and we want our nimbus to go to folks who will use it. This is all part of our Return Policy and is highlighted separately below.
  • You will have to see an ad panel on screen if you are a free customer. Just like all that good stuff on your free TV or on those free websites, we are bringing you a free computer. Don’t worry, this isn't Times Square! All of our interactive advertising is limited to this ad panel which is tastefully located on the right side and will never take up more than about 15% of your screen. Sure you can opt-out. If you don’t want an ad panel, there will be a per month subscription fee.
  • Use guidelines: Basically we ask that you comply with all laws and also that you don’t damage our service or data centers. That seems reasonable to us :) All current terms and conditions are in the on-line document. This saves a lot of paper and also this way everyone is on the same page.

Your Personal Information and other Data we Collect

We use the internet just like you do and we think your privacy is very important. We collect information the same way some popular websites do. This is to make the service more convenient (don't you like it when websites remember who you are?) and to also provide useful advertising. We may use cookies or other technology to make this possible. When you sign up for our service we collect information about you to personalize your service as well.

What we do with the data we collect

At no time does data about your identity (who you are) ever come in contact with data about what you do. It's like matter and anti-matter to us! Just like the heroes in “Ghostbusters” won't “cross the streams”, we will never put them together! We use this data to create better products suited to how you use our service. And we create better targeted, more relevant interactive sponsorship opportunities so that we can continue to provide a high quality service for free.

Cancellation and Return Policy Summary

Your service with us is month-to-month and no long term agreements are required. You can cancel your service with us at anytime. We just require that you return the nimbus device.

For Free customers:

You may cancel your service at any time. Upon cancellation you will be required to return the nimbus device that we included when you subscribed to your service. In the event that we do not receive these items back within 90 days, you will be charged $50.

We want to make sure that our free service is used. For periods of continuous Non-Activity (zero use) of 30 days, we will cancel service. In that event, the return of the device and any additional materials we sent will be required as above.

For Subscription customers:

You may cancel your service at any time. Upon cancelation you will be required to return the nimbus device and any additional materials that we included when you purchased your service. In the event that we do not receive these items back with 90 days, you will be charged $50.
